Terms of Service

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement.

If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Account Registration

You must provide accurate information when creating an account.

You are responsible for maintaining the security of your account. We use passwordless magic link authentication.

You must notify us immediately if you suspect unauthorised access to your account.

3. The Service

ProperVid generates marketing videos from property listing images and descriptions using AI-powered tools.

We do not guarantee specific results, outcomes, or performance from videos generated using our platform.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

4. Your Content

You retain all rights to the images, descriptions, and other content you upload to ProperVid.

By uploading content, you grant us a limited licence to process, transform, and store it for the purpose of providing the Service.

You are responsible for ensuring you have the right to use any content you upload (including property images, logos, and descriptions).

You must not upload content that is illegal, infringing, defamatory, or harmful.

5. Generated Videos

You own the videos generated by ProperVid from your content.

AI-generated scripts and voiceovers are created for your use and may be used freely in your marketing.

We retain the right to use anonymised, aggregated usage data for service improvement.

6. Payments and Subscriptions

Paid plans are billed in advance on a monthly or annual basis via Stripe.

All prices are displayed in your selected currency and are inclusive of applicable taxes unless stated otherwise.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

Refunds are provided at our discretion for unused portions of annual plans. Monthly plans are non-refundable.

7. API Usage

API access is subject to rate limits based on your subscription tier.

API keys are confidential. You are responsible for all activity under your API key.

We may suspend API access if we detect abuse, excessive usage, or violations of these Terms.

8. Acceptable Use

You agree not to: use the Service for any illegal purpose; attempt to reverse engineer or extract our AI models; overload or disrupt the Service; resell access to the Service without our written consent; use the Service to generate misleading property listings.

9. Limitation of Liability

To the maximum extent permitted by law, ProperVid shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold ProperVid harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity harmful to the Service or other users.

Upon termination, your right to use the Service ceases immediately. We will retain your data in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are an EU consumer, you retain any mandatory consumer protections available under your local law.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect.

Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
